Please read these Terms and Conditions (“Terms”) carefully before using the FurnitureFly website or purchasing any products from FurnitureFly . By accessing, browsing, or placing an order on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our [Privacy Policy] and [Return & Refund Policy]. If you do not agree with any part of these Terms, please do not use the Site.
1. Definitions
“Site” refers to www.furniturefly.com and all associated sub‑domains.
“Product(s)” means any furniture, accessories, or services listed for sale on the Site.
“User Content” means any reviews, ratings, images, comments, or other content you post or upload to the Site.
“Business Day” means Monday – Saturday, excluding public holidays in India.
2. Eligibility & Account Registration
You must be at least 18 years old and capable of entering into a legally binding contract under Indian law.
To place orders, you may create an account by providing accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Ordering & Contract Formation
All orders are subject to acceptance and availability.
After you place an order, you will receive an email acknowledging receipt. This email does not constitute acceptance. The contract is formed only when we send a dispatch confirmation email or SMS.
We reserve the right to refuse or cancel any order for reasons including but not limited to Product availability, errors in description or price, suspected fraud, or violation of these Terms.
4. Pricing & Payment
All prices are listed in Indian Rupees (INR) and include GST unless stated otherwise.
We accept major credit/debit cards, UPI, Net Banking, and Cash on Delivery (where available).
Prices and offers are subject to change without prior notice. The price applicable is the one shown at checkout at the time of order placement.
In case of pricing errors, we may cancel the order and issue a full refund.
5. Shipping & Delivery
Estimated delivery times are displayed at checkout and in your order confirmation email. They are indicative and may vary due to logistics constraints.
Risk of loss and title pass to you upon delivery of the Product to your address.
Please inspect all Products upon delivery. Any transit damage must be reported within 48 hours with photographic evidence.
6. Cancellations, Returns & Refunds
Order Cancellation:
Before dispatch: You may cancel for a full refund.
After dispatch: Cancellation is treated as a return (see below).
Returns & Refunds: Governed by our separate Return & Refund Policy, incorporated herein by reference.
Refunds are processed to the original payment method within 7–10 Business Days after approval.
7. Promotions, Coupons & Gift Cards
Promotional codes must be entered at checkout to be valid; they cannot be applied retroactively.
Each code may have specific terms such as expiry date, minimum order value, or single‑use limitations.
Gift cards are non‑refundable and cannot be redeemed for cash.
8. Product Information, Warranty & Assembly
We strive to display Product colors and finishes accurately; however, variations may occur due to screen settings or natural wood grain.
Unless stated, Products come with a 1‑year limited warranty against manufacturing defects. Normal wear and tear, misuse, or improper maintenance are not covered.
Some items may require self‑assembly. Assembly instructions are provided; incorrect assembly voids the warranty.
9. Intellectual Property
All content on the Site—text, graphics, logos, images, videos, and software—is owned by or licensed to FurnitureFly and protected under Indian copyright and trademark laws.
You may view, download, and print portions of the Site solely for personal, non‑commercial use. Any other use requires our prior written consent.
10. User Content
You grant FurnitureFly a non‑exclusive, perpetual, worldwide, royalty‑free license to use, reproduce, modify, and display any User Content you submit.
You represent that you own or control all rights to the User Content and that it does not infringe any third‑party rights.
We may, but are not obligated to, monitor or remove any User Content that violates these Terms or is otherwise objectionable.
11. Prohibited Conduct
You agree not to:
Use the Site for unlawful, fraudulent, or harmful purposes.
Upload viruses, malware, or any code designed to disrupt Site functionality.
Attempt to gain unauthorized access to other user accounts or our servers.
Engage in any activity that imposes an unreasonable load on our infrastructure.
Violation may result in immediate termination of your account and legal action.
12. Third‑Party Links & Services
The Site may contain links to third‑party websites. We are not responsible for the content, privacy policies, or practices of such sites. Your dealings with third parties are solely between you and the third party.
13. Privacy
Your submission of personal information is governed by our Privacy Policy, which explains how we collect, use, and protect your data.
14. Disclaimer of Warranties
Except as expressly stated, the Site and Products are provided “as is” and “as available.” We make no other warranties, express or implied, including fitness for a particular purpose or non‑infringement. We do not warrant that the Site will be error‑free or uninterrupted.
15. Limitation of Liability
To the fullest extent permitted by law, FurnitureFly shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your use of the Site or Products. Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid for the Product giving rise to the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless FurnitureFly, its directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms or your misuse of the Site.
17. Termination
We may suspend or terminate your account and access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved through negotiations in good faith. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.
19. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes become effective when posted on the Site. Continued use after modifications signifies acceptance.
